Hiday LLC (“Hiday,” “we,” “us,” or “our”) owns and operates the website located at hiday.net (the “Website”). This Privacy Policy describes what information we collect through the Website, how we use it, when we share it, and the choices you have.

Hiday LLC is not a real estate brokerage. Real estate services advertised on the Website are provided by James Hairston, Texas Sales Agent License No. 812920, sponsored by HEI Brokerage, LLC, Texas Broker License No. 9014177. When you submit an inquiry about a property or about real estate services, we share that inquiry with James Hairston at HEI Brokerage, LLC so that he can respond. That is the primary reason we collect information at all.
This Privacy Policy applies only to the Website. It does not apply to information collected offline, to information collected by HEI Brokerage, LLC or Huffines Enterprises through their own websites or operations, or to any third-party website.

Your Choices and Rights
Opting out of contact. Email james@hiday.net and we will stop contacting you.
Access, correction, and deletion. You may ask us what personal information we hold about you, ask us to correct it, or ask us to delete it. Email james@hiday.net. We will respond within a reasonable period and, where a law establishes a deadline, within that deadline. We may need to verify your identity before acting on a request.
Texas residents. The Texas Data Privacy and Security Act gives Texas residents rights to access, correct, delete, and obtain a copy of their personal data, and to opt out of targeted advertising, the sale of personal data, and certain profiling. We do not engage in targeted advertising, sale of personal data, or profiling through the Website. To exercise your other rights, email james@hiday.net. If we deny your request, you may appeal by replying to our response, and you may file a complaint with the Texas Attorney General.
California residents. California’s “Shine the Light” law (Civil Code § 1798.83) permits California residents to request information about disclosures of personal information to third parties for those third parties’ direct marketing purposes. Third-party removal. We cannot remove your information from the systems of any third party who obtained it independently of us.
Data Retention
We keep inquiry information for as long as needed to respond to you and to maintain records of our communications, and thereafter as required by applicable law, including Texas real estate recordkeeping requirements applicable to HEI Brokerage, LLC. Server logs are retained for a limited period for security and troubleshooting. When information is no longer needed, we delete it or de-identify it.
Security
We use commercially reasonable measures designed to protect personal information against accidental loss and unauthorized access, use, alteration, and disclosure. The Website is served over an encrypted connection.
No transmission of information over the internet is completely secure. Although we take reasonable steps, we cannot guarantee the security of information transmitted to us. Any transmission is at your own risk.
The Website does not process payments. Please do not send payment information through the Website.

Governing Law and Venue
This Privacy Policy is governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute relating to this Privacy Policy is subject to the dispute resolution, arbitration, class action waiver, and venue provisions of our Terms of Service, including your right to opt out of arbitration within 30 days and to bring qualifying claims in small claims court in Dallas County, Texas.
